The U.S. Supreme Court today upheld a lower court ruling that the app owned by China’s ByteDance must sell itself or be banned in the U.S. on Sunday due to national security concerns. The justices called TikTok “a distinctive and expansive outlet for expression, means of engagement, and source of community.” Nevertheless, they added, "Congress has determined that divestiture is necessary to address its well-supported national security concerns regarding TikTok’s data collection practices and relationship with a foreign adversary.” Those concerns override the First Amendment protections the social media platform had sought. When the law goes into effect, the onus will not be on TikTok, but on app stores to stop making the social media platform available to users. Presumably, those who already have the app installed would be able to continue to use it, but they would not be able to receive routine updates, something that eventually would make it unworkable. The Information reported that TikTok was preparing to go dark in the U.S. on Sunday, a move that would send a message to users of the impact of the law.
